These Terms of Service ("Terms") govern your use of the MotionDock macOS application, wallpaper marketplace, and related services operated by an independent developer. By using MotionDock, you agree to these Terms.
1. Using MotionDock
You may use MotionDock only in compliance with these Terms and applicable law. You are responsible for maintaining compatible hardware, software, and internet access. MotionDock is designed for supported versions of macOS and may not work on every device or operating system version.
2. Accounts
Some features, including marketplace publishing, require an account. You must provide accurate information, protect access to your account, and notify us if you believe your account has been compromised. You are responsible for activity that occurs through your account.
3. User Content
You retain ownership of content you upload. By publishing content through MotionDock, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, distribute, and make that content available through MotionDock for the purpose of operating, maintaining, and improving the service.
You represent that you own your content or have all permissions necessary to upload and distribute it. You must not upload content that infringes intellectual property, privacy, publicity, or other rights.
4. Marketplace Rules
You may not upload or distribute content that is unlawful, harmful, deceptive, malicious, sexually exploitative, hateful, or designed to interfere with devices or services. We may review, restrict, hide, or remove content, and may limit accounts that violate these Terms or create risk for users or the service. We may also remove content in response to intellectual property complaints or other legal requests.
5. Intellectual Property
MotionDock, including its software, visual design, branding, and original content, is owned by MotionDock or its licensors and is protected by applicable intellectual property laws. These Terms do not grant you ownership of MotionDock or other users’ content.
6. Acceptable Use
You may not reverse engineer MotionDock except where applicable law permits it, bypass security or usage limits, misuse accounts, scrape the service at scale, introduce malicious code, disrupt infrastructure, or use MotionDock to violate another person’s rights.
7. Third-Party Services
MotionDock relies on third-party services for functions such as App Store distribution, sign-in, hosting, databases, and file delivery. Your use of those services may also be governed by their terms. We are not responsible for third-party services outside our control.
8. Availability and Changes
We may add, change, suspend, or discontinue features to maintain, secure, or improve MotionDock. We do not guarantee that every feature or item will always be available, and marketplace content may be removed without notice when reasonably necessary.
9. Termination
You may stop using MotionDock at any time. We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, or misuse the service. Provisions that by their nature should survive termination will continue to apply.
10. Disclaimers
To the extent permitted by law, MotionDock is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
11. Limitation of Liability
To the extent permitted by law, MotionDock will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or business opportunity arising from use of the service. Our aggregate liability will not exceed the greater of the amount you paid for MotionDock during the 12 months before the event giving rise to the claim or USD $100.
12. Changes to These Terms
We may update these Terms as MotionDock evolves. We will post revised Terms here and update the date above. Continued use after revised Terms take effect means you accept them.
